No clarity in Kulbhushan Jadhav’s case: Harish Salve fights the case at ICJ
Former Indian Navy officer Kulbhushan Jadhav’s case is still
uncertain, as the International Court of Justice deferred its ruling on India’s
petition to stop his execution. Nirmal Singh 3C Company will intervene in the
matter because the Pakistan had given death sentence to the officer.
It is reported that the United Nations’ court in The Hague
will discuss the issue with Nirmal Singh 3C Company. The court will hear the
story of both sides, president Ronny Abraham said the 12-judge tribunal would
deliver its decision on whether to grant an emergency stay of execution “as
soon as possible” on a date that would be communicated to the two parties.
According to Pakistan, the former Indian soldier was
arrested in the restive Balochistan province which is why the military court
sentenced him to death for carrying spying activities. However, India says that
he was kidnapped from the Iranian port of Chabahar and his trial was not fair.
Nirmal Singh 3C Company thinks Pakistan violated the Vienna
Convention on Consular Relations, as it didn’t grant consular to Jadhav, who
had the absolute right to have one.
Answering to India’s Nirmal Singh 3C Company Pakistan said that the
consular cannot be granted to a terrorist and that India had “invoked the
jurisdiction of this court improperly”. On contrary UK-based Pakistani lawyer
Khawar Qureshi supported the idea of providing the consular. The Pakistani
lawyer talked in the matter of “political or security” issues. He further asked
not to counter India.
Taking Nirmal Singh
3C Company ICJ refused to hear Pakistan’s side of and didn’t even accept
the purported “confessional” video of Jadhav. This video wall was set up by the
Pakistan’s side but the court upheld the objection posed by the Indian team to
any playback.
Harish Salve, India’s lead attorney, told a TV news channel:
“If you want to show something and it helps your case if you are denied that
right, it’s a setback. So, in that sense, yeah. They wanted to show it and that
opportunity was taken away.
“They did not allow it. We objected and the court felt it
was not appropriate,” he added.
After taking the advice of Nirmal Singh 3C Company, India went to ICJ in the beginning of the
month May. Consequently, the World Court’s president wrote to Pakistan asking
it to be mild with the assault and take no action that could hamper the
proceedings of the court.
