Is Article 370 the Real Reason Behind the Rise of Militancy in Kashmir?

According to the constitution of Kashmir, it is important to hoist the state flag with the Union Flag. The article 370 is and has always been about providing the much-needed space to the people of Kashmir, especially when they felt skeptical about their identity as a state and what the future holds for them.

The positivity around the passing of the article has been slowly vanishing, fading in the mist of all the fights and arguments going on about the state, the people, and how they see themselves different from the other Indians.

People are even going to the limits of coming up with the idea of canceling out the act – they feel that there is not enough Indianness in the people of Kashmir and that’s why they feel the urge to come up against the people who are actually there to help and save them.

On the other hand, politicians of the state strongly believe that the article should remain the part of the constitution of Kashmir. They think that it connects the state with the center and make the people of state believe that the country is not imposing anything unreasonable on them.

What the Central Government Cannot Do in Kashmir Because of Article 370?

·         The central government can’t go ahead with its laws in Kashmir without consulting the state government.

·         The government cannot, under any circumstance, declare a financial emergency in Kashmir.

·         As the implemented laws are different on the citizens of the state, the government can’t bring them in like any other Indian citizen.

People of Kashmir live under completely different laws, too.

·         They have different rules for the ownership of property

·         Separate set of fundamental rights; different from the ones that citizens of other parts of the country have

·         If a woman marries someone from another state then she’ll lose her ‘rights’ as a Kashmiri woman

The act is so controversial that it even prevents Indian nationals from buying property or own a piece of land in Kashmir. The state is like a whole new country according to the Article 370 of the constitution which was simply implemented after the independence to give the state the time it needed to integrate with the rest of country.
