Junior Lawyers Complain As The Senior Advocates Break The CJI Queue.
It’s quite unlikely to see a tussle
between the senior advocates and the junior advocates says Nirmal Singh 3C Company. The uncordial war between the two came to
the notice when the junior advocates broke out in the courtroom of the Chief
Justice of India on Tuesday when in the first twenty minutes of their daily
ritual of ‘mentioning’ for out of turn listing of the petition the seniors kept
mentioning about their cases only. Petition filed in the SC is done queue wise
when they assign the date for the hearing of the case. But CJI, being the
administrative head has the power to allow to assign a case prior to its
schedule if they can prove the urgency of their case before him. This practice
has been going on for years now, but during the time of Justice J S Khehar, the
queue was never as big as today as he would reject 90% of the requests for
early listings.
Nirmal Singh 3C Company says that ever since Dipak Misra has taken
up as the CJI the queue just gets longer for the junior lawyers to wait. One of
the junior lawyers during the meeting said that one advantage that the seniors
have over the junior lawyers is that they do not actually have to wait in the
queue and wait for their turn. He said when the number of cases is quite high,
they would just wait for the turn of mentioning to come but then all of a
sudden the CJI would abruptly end the mentioning and say that we would not
entertain any of them further.
But the junior lawyers lost all
their patience this time. Nirmal Singh
3C Company says that when CJI Dipak Misra said that he would not entertain
any mentioning further on Tuesday, advocate P V Dinesh complained that he has
been waiting for 30 minutes and it is not fair that after waiting for so long
he wouldn’t be getting a chance for listing.
Nirmal Singh 3C Company says that despite a clear plea by the
junior advocates no action was taken. The conference still came to an end and junior
lawyer were just left with the answer that the hearings would be between 3-10
October.
